Defining the Boundaries of Play
WinZO App is a platform founded on the principle of skill-based gaming, recognized as a legitimate business activity under Indian law. However, participation comes with responsibilities. This Disclaimer and Terms & Conditions document serves as the legal contract between you and WinZO. It is designed to clarify the legal status of our games, outline user eligibility, and establish the rules of engagement to ensure a fair, transparent, and legally compliant environment.

1. Nature of Games: Game of Skill vs. Game of Chance
A cornerstone of our legal standing is the distinction between “games of skill” and “games of chance.”

  • Legal Basis: Under Indian jurisprudence, particularly the Supreme Court’s rulings in State of Andhra Pradesh vs. K. Satyanarayana (1968) and K.R. Lakshmanan vs. State of Tamil Nadu (1996), games where success depends predominantly upon the player’s knowledge, training, attention, experience, and dexterity are classified as games of skill.
  • WinZO’s Portfolio: All games offered on WinZO APP—including fantasy sports, trivia, puzzles, and arcade-based challenges—require significant skill. Winning outcomes are determined by the user’s cognitive abilities, strategic planning, and real-time decision-making, not by random number generation (RNG) alone.
  • Legality: Skill gaming is legal in most Indian states. However, we restrict access to users in states where real-money gaming is prohibited (e.g., Telangana, Andhra Pradesh, Assam, Odisha, Sikkim, and Nagaland). It is your responsibility to ensure your participation complies with the laws of your jurisdiction.

2. Eligibility and Account Registration
To use WinZO, you must meet the following criteria:

  • Age: You must be 18 years or older. We employ age-verification checks during KYC to prevent minors from accessing the platform.
  • Residency: You must be a resident of India (or an NRI subject to local laws). International users are subject to the specific laws of their country of residence.
  • One Account Per User: You are permitted to maintain only one user account. Creating multiple accounts (“syndicates”) to manipulate leaderboards or circumvent withdrawal limits constitutes a violation of our terms and will result in permanent bans and forfeiture of winnings.

3. Financial Terms and Taxation
Real-money gaming involves financial risk. By participating, you acknowledge:

  • Deposits: Deposits are made voluntarily. WinZO does not provide credit or loans for gameplay.
  • Withdrawals: Withdrawals are subject to minimum and maximum limits as displayed in the app. Users must complete full KYC (PAN card verification) to withdraw funds above the threshold defined by the Prevention of Money Laundering Act (PMLA), 2002.
  • Tax Deducted at Source (TDS): Under Section 194B of the Income Tax Act, 1961, we are legally obligated to deduct TDS at 30% on net winnings exceeding ₹10,000 in a financial year. This tax is deposited with the Government of India. Users are responsible for filing their own income tax returns.

4. Prohibited Conduct
WinZO maintains a zero-tolerance policy for unfair practices. The following actions are strictly prohibited and will lead to immediate suspension:

  • Cheating & Collusion: Using bots, scripts, automated software, or coordinating with other players to gain an unfair advantage.
  • Hacking: Attempting to breach our security protocols or manipulate game code.
  • Harassment: Abusive language, hate speech, or threats directed at other players or customer support staff.
  • Money Laundering: Using the platform to convert illicit funds or engaging in circular transactions (depositing and withdrawing without genuine gameplay).

5. Intellectual Property
All content on the WinZO platform—including but not limited to the app interface, game designs, logos, and graphics—is the exclusive property of WinZO Games Private Limited. You are granted a non-exclusive, non-transferable license to use the software for personal entertainment purposes. Reverse engineering, copying, or redistributing any part of the app is a violation of our copyright.

6. Limitation of Liability
While we strive for 99.99% uptime, WinZO is not liable for:

  • Technical Glitches: Occasional downtime due to server maintenance, internet outages, or issues with third-party payment gateways.
  • Loss of Data: Users are advised to keep records of their transactions. We maintain backups, but in the event of a catastrophic failure, liability is limited to the restoration of available data.
  • Gambling Addiction: WinZO provides a platform for skill gaming. We are not liable for personal financial losses incurred due to irresponsible gameplay. (Refer to our Responsible Gaming section for tools to manage playtime.)

7. Dispute Resolution and Grievance Redressal
In the spirit of the IT Rules, 2021 (amended 2026), we have a robust grievance mechanism:

  • Grievance Officer: All disputes regarding accounts, gameplay, or payments should be directed to our Grievance Officer, whose details are listed in the app under “Legal.”
  • Jurisdiction: Any legal disputes arising from the use of WinZO shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
  • Binding Arbitration: Minor disputes may be resolved via binding arbitration as per the Arbitration and Conciliation Act, 1996, to ensure speedy resolution.

8. Amendments
We reserve the right to modify these Terms & Conditions at any time. Users will be notified of significant changes via in-app notifications or email. Continued use of the platform after such modifications constitutes acceptance of the updated terms.
